Is CBD legal in Florida? What about CBD oil?

The short answer is yes! CBD oil and other CBD products are fully legal throughout all of Florida — just as long as these products meet a few qualifications.

If you live in Florida or are planning a trip down, then this article is for you.

CBD oil was federally legalized through the 2018 Farm Bill, which means it’s legal in all 50 states. Florida sided with federal law and legalized CBD, too. <1>

The 2018 Farm Bill was a big deal for those in the hemp/CBD world.

This bill called for the complete legalization and decriminalization of industrial hemp. It legalized hemp-derived cannabinoid products, too, so long as they contained under 0.3% THC. The bill even stripped federal agencies of their prosecuting power, allowing for CBD hemp-derived products to be made and sold freely! Once the bill was enacted into law, CBD’s popularity took off.

The state of Florida, like nearly all states, has sided with the Farm Bill.

“CBD and Hemp are legal to both cultivate and consume in the state of Florida for anyone over the age of 18 so long as the product contains less than 0.3% THC content.” confirms the Orlando Law Group. “<...> No licensing is required to consume hemp products in Florida <...>.” <2>

And here are the nitty gritty details, straight from Florida Bill SB 1020 itself:

  • Legalized hemp, which the law defined as a plant containing less than .3% THC by weight, the same as the federal standard.
  • Legalized hemp extracts, defined as any substance derived from legal hemp plants that do not contain other controlled substances and are intended for ingestion.
  • Legalized CBD and other hemp-derived cannabinoids (they’re no longer controlled substances)

Under both state and federal law, virtually every type of hemp-derived CBD product is legal in Florida, including CBD drops, oils, edibles, vape pens, and much more. In addition, the state views CBD topicals as “cosmetic products,” making them even more permissible in the eyes of the law.

Floridians can easily buy CBD from local stores without needing a license or ‘green card.’ They can also buy CBD from any of the premium brands available online. You can even buy CBD from restaurants and cafes, where infusing CBD into drinks is popular. (Unlike many other states, Florida hasn’t installed any regulations against this trendy practice.)

We’ve got good news: CBD is fully legal in Florida. And, unlike in some other states, law enforcement has gotten fully on board!

CBD seems to be most popular in Florida’s big cities, including Miami and the surrounding areas, though at this point, it’s pretty popular everywhere.

Just like CBD products, hemp farming is entirely legal in Florida. As a result, many Floridian farmers have successfully turned to hemp to supplement their normal farming income!

According to state law, hemp farmers must be fully licensed before they begin to grow the crop. The state also tests crops at harvest time to ensure that they fall below the 0.3% legal limit for THC.

Licensing is needed for all Floridians who want to sell hemp/CBD products. Here’s more info from the Orlando Law Group: <3>

“To sell CBD/Hemp in an ingestible manner, whether prepackaged or not, you must have a food establishment permit. Additionally, there are further licensing requirements if your products have dairy or frozen components.”

The products being sold must meet certain standards, too. Florida law requires that CBD products have the following info on their labels in order to be considered legal: <4>

  • A scannable QR code/barcode that’s linked to valid lab testing
  • A product batch number
  • A website containing information on that batch
  • An expiration date.
  • The amount of CBD or hemp extract contained in the product (in milligrams)
  • A statement that confirms the product contains <0.3% THC

Most reputable CBD manufacturers include all these things as part of their packaging — in addition to the following:

  • The product’s net weight
  • A complete supplement fact panel
  • The product’s suggested use
  • The manufacturer/distributor’s name
  • The product’s type (full spectrum, broad spectrum, etc.)

Ordering CBD online in Florida is both legal and easy. In addition, CBD products can be shipped to any part of the state.
